Motorcycle Helmet Laws Can Save Your Life in a Motorcycle Accident

Massachusetts is one of only 20 states that require motorcycle riders to wear approved helmets while operating or riding a motorcycle. Massachusetts' motorcycle helmet laws were implemented for one reason: Motorcycle helmets can save lives during motorcycle accidents.

Not surprisingly, the leading injuries in motorcycle accidents are head injuries, including traumatic brain injuries (TBI). Because a motorcycle does not afford the rider the steel cage protection a car does; there is little to no protection on a motorcycle. Many times, a motorcycle helmet is the only thing between the rider and the road during a motorcycle accident.

Massachusetts Motorcycle Helmet Laws

Massachusetts motorcycle helmet laws mandate that:

o Every person operating or riding as a passenger on a motorcycle (including in a sidecar) must wear protective headgear AND
o The headgear must conform with specific minimum standards
o No operator may allow a passenger to ride without protective headgear.

The one exception to this law is that operators and passengers can ride motorcycles without helmets if:

o The motorcyclist is participating in a properly permitted public parade AND
o The parade participant is 18 years of age or older.

Benefits of the Massachusetts Helmet Law

According to statistics from the federal government, in 2006, there were 35 times more deaths on motorcycles per mile traveled than in cars. In 2007, there were more motorcyclists' deaths from motorcycle accidents than in any previously recorded year, according to the National Highway Traffic Safety Administration (NHTSA).

There are a number of reasons why Massachusetts motorcycle helmet laws are enforced, and why motorcycle riders are vulnerable to accident and injury:

o Motorcycles can attain very high speeds very rapidly
o Motorcycles are unenclosed
o Motorcycles are not stable in high speed braking situations
o Motorcycles are less visible than other vehicles

Helmets have been proven effective in preventing brain injuries (TBI) and studies have shown they reduce the possibility that a crash will be fatal by 37%.

Studies have also shown that when motorcycle helmet laws are enacted, riders wear helmets nearly 100% of the time. According to the NHTSA, when there is no helmet law present, motorcycle helmet use drops to approximately 50%.

Massachusetts Motorcycle Accident Lawsuits

It is important to note however, that not wearing a motorcycle helmet during a Massachusetts motorcycle accident does not mean the other vehicle was not responsible for the crash. It also means that the motorcycle accident victim may still be entitled to financial compensation for their injuries.

Insurance Settlement Negotiation

The process of negotiating for a settlement- whether it be for an injury, car crash or malpractice - is essentially the same. Motorcycle accidents often cause horrible personal injury cases, but they follow the same pattern. Once you submit a demand letter the next step is negotiation.

Before the negotiation begins, you must submit a demand letter tot he insurance companies laying out your claim with supporting evidence. If you are lucky then the next step is just a few calls with your insurance company and your personal injury lawyer. These insurance companies negotiate like this all the time so it is no sweat for them. Treat it like a business deal as emotionless as possible to stay on your senses.

In the call, you and the adjuster will argue by going over the strong and weak points of each side's proposal. The adjuster's job is to low-ball you with a settlement lower than the one in your demand letter. Your job is to counter with an offer in between the demand price and the adjuster's offer. If you get a reservation of rights letter, it does not necessarily mean you have to run off to the best Denver injury attorney you can find. This is just a letter that protects the insurance company by saying that entering into negotiations does not necessarily mean that they will pay or are liable.

Your best protection from a insurance adjuster is preparation. You want to go into the negotiations with a figure in mind of the minimum you will accept. You do not tell the adjuster this number, but you will use it to help determine what you do in the negotiations. If they start off with a number already near your minimum that is good news and you can try to adjust that number to get more. If they point out some holes in your case that might make it hard to argue in court, you and your Denver accident attorney may have to revise downward.

Nerves of steel are not required, but self control is. Do not just jump at the first offer because it is probably just a ploy to see how little it will take to placate you. If you were involved in a serious Denver personal injury case, you need to stay strong in negotiations, because once the settlement is over the case can never be re-opened. You want to stay emotionless, but emphasize emotional points that would be likely to get a jury crying to open the defendant's pocketbook.

If the adjuster gives you a low but not unreasonable offer- go forward with negotiations. If the offer is completely unreasonable they are probably just testing you so ask why it is so low and go over every point they give on why. Once you have reached a agreeable number, put that into writing with a letter to the insurance company stating the amount, what that amount covers and when you expect payment.

Auto Accident Personal Injury Claim - How Much Should You Settle a Car Accident Claim For?

Are you in the process of filing an auto accident personal injury claim? In this article we are going to talk about the question "How much should you settle a car accident claim for?"

Having a car crash can be quite a bit of trouble. It takes up your time, damages your property and could even injure your body or others that are in your vehicle. On top of all of this you may have to file an auto accident personal injury claim so that you can get your auto accident settlement. Let's go on to talk about the question "How much should you settle a car accident claim for?"

Extent Of Damages

Ever crash is different so there is no one amount that you should settle for. You need to total together your damages. While a smashed door may be worth a couple of hundred dollars a totaled car may be worth a few thousand.

You should take your car to be checked out by at least two auto body shops before you even consider settling your case.

Extent Of Injuries

Injuries are also going to come into play when it comes to your settlement. A broken nose would be worth much less in an auto accident settlement than say a broken neck.

Conclusion

There are a couple of things that you can do:

Consult with an auto accident attorney
Take care of the claim yourself

If you take care of the claim by yourself I suggest that you get a guide book that will help guide you through the process. There are a few different places that you can find these books online. They will walk you step by step through the process or if you are not a do it yourself person you can find a no win no fee lawyer online easily as well.

Newport Beach Car Accident Lawyers Are Key Advocates For Your Rights

Newport Beach in Orange County, California has a disproportionate share of expensive cars. This is a city where Porsches, Mercedes and BMWs move quickly and drivers are more than likely distracted by cell phones, iPods, BlackBerrys and other high-tech "toys." Under these conditions, skilled Newport Beach car accident lawyers will acknowledge that collisions often occur.

Car Accident Statistics Underscore the Need for Caution

Statistics compiled by the California Highway Patrol's Statewide Integrated Traffic Records System (SWITRS) showed that in 2006, four people were killed and 513 were injured in Newport Beach car crashes. Two pedestrians lost their lives and 32 were injured. One bicyclist was killed and 92 suffered injuries. Motorcycle accidents injured 18. Additionally, DUI crashes resulted in three fatalities and 70 injuries. In 2007, four car accidents resulted in as many fatalities.

Italian Sports Car Split in Half, Female Passenger Ejected

In March 2009, a man driving a red Ferrari crashed into a light pole in Newport Beach, causing the vehicle to split in two. The violent crash occurred shortly after midnight on Jamboree Road near Camelback Street. Police noted that when the Italian sports car split it in half, the driver was killed, and his female passenger was ejected and hospitalized for her injuries. What caused the driver to lose control is unclear.

Insurance Companies May Not Be Looking Out for You

When accidents occur, Newport Beach car accident lawyers advise those involved to seek the advice of an experienced attorney. If you are a victim of a car accident, you can't depend on an insurance company to look out for your interests. And that includes your own insurance company. Keep in mind that their goal is to limit the amount of compensation for which you may be entitled. In other words, the adjusters, investigators, and attorneys assigned to auto accident claims on behalf of your insurance company may not be looking out for your best interest.

Why You Should Consult an Experienced Car Accident Lawyer

The thing to remember is that each and every traffic injury accident or motorized vehicle injury accident or crash is unique, and to ensure that you will be justly compensated for your loss requires the skill and knowledge of an experienced California personal injury attorney. When choosing a Newport Beach car crash lawyer to represent you, the initial consultation should be free of charge. Your goal here is to learn about you options and ask questions without feeling any pressure to retain the law firm. Once retained, your lawyer should be responsive to your needs, return your phone calls promptly, and be genuinely interested in your welfare.

Motorcycle Accident Injuries

Sometimes when I am out driving I notice small signs that say "Pay Attention: Motorcycles are out there too" (or something to that effect). It seems odd at first that people would go out of their way to draw attention to motorcycles, but once you start to hear some statistics about motorcycle accidents it becomes more obvious. Motorcyclists are at a distinct risk of injury and even death every time they go out onto the road.

Why Are Motorcyclists at Enhanced Risk?

At first glance it may seem like motorcycles are safer on the road because they have the ability to maneuver quickly and have enhanced agility over cars. Unfortunately, despite that added mobility, vehicular drivers are statistically more likely to completely overlook motorcycles and cause serious accidents. Even with their heads on a swivel, motorcyclists are at an increased risk or collision.

Another problem cyclists face is the road itself. Gravel, potholes and other such variables are nothing more than a nuisance to vehicular drivers, but can cause instability and outright crashes for motorcycles.

The light weight, two wheel design, and speed of the motorcycle naturally increases the disruption caused by even small road inconsistencies. A surprisingly large amount of motorcycle accidents involve no other vehicles, and are even more frequent when alcohol is involved.

Some Statistics

For purely informational purposes, here are some statistics regarding accidents:

* There were 4,778 people killed in motorcycle accidents in 2006
* In 2007, 28 percent of motorcyclists who died had blood alcohol levels of.08 g/DL or higher
* In 2/3 of motorcycle accidents with other vehicles, the driver of the other vehicle violated the motorcycle rider's right of way and subsequently caused the accident
* Motorcyclists are about 26 times more likely to die in a crash than someone riding in a passenger car, and are 5 times as likely to be injured

A Look at Injuries

Fender benders happen thousands of times every day, but we don't think much of it. The reason why is because the injuries involved are minor to none. However, when it comes to motorcycles, even a slow speed loss of control can result in bruises, road burns, and broken bones.

Motorcyclists are constantly encouraged to where leathers and helmets at all times because history has shown that the probability of injury is extremely high. During collisions, broken bones and lacerations are almost a minimum of what can be expected. Without proper head protection, severe trauma is a distinct possibility.

Legal Rights

As mentioned above, almost 2/3 of motorcycle accidents are instigated by error on the part of a vehicular driver. With that probability in mind, it is critical for cyclists to be aware of their legal rights.

We all remember going through driver's school in order to get our licenses, but those programs hardly entail all of the subtleties that go into driving law. In order to properly deal with the opposing party, the insurance companies, and the medical community for injuries, it is imperative to get in contact with a local lawyer who specializes in these concerns. You must find someone who will understand the chaotic times that come from these injuries and can help you get your life back in proper working order.

How Does a Personal Injury Claim Work?

If you have been in an auto or motorcycle accident and you were not at fault, then chances are you are going to file a personal injury claim. Out of nowhere you will receive tons of mailers from personal injury attorneys who want to represent your case. They will be willing to bend over backwards to accommodate your schedule and your location. Why do they go to this much trouble? Well, your claim could be worth a lot of money. Being a personal injury lawyer can be quite lucrative if he or she knows what they are doing.

A common personal injury case is one that involves a vehicle. You are driving along and suddenly another person wrecks into your auto. If you are not at fault, then the other person is responsible for the repair to your vehicle and any medical bills that are incurred as a result of this accident. A personal injury claim enters into the picture when you need to receive monetary compensation for a new vehicle, lost time at work and any medical fees.

Many people will automatically have their vehicle and medical bills covered up to a certain amount. That predetermined dollar amount is based on how much insurance the at-fault person has with their insurance company. If your medical bills are above that amount, then you may have to seek out a personal injury attorney to get money from the insurance company.

If you have pain and suffering that has not been addressed, then your accident attorney will come up with a dollar amount to add to the injury claim. Every single expense is added up, totaled and presented to the insurance company.

Once your injury attorney has spoken or communicated with the insurance company's attorney, they will often reach a settlement. If the offered amount is too low, it can often wind up going to court. This is the arena in which your attorney shines. This type of attorney is very familiar with the accident laws of your state and will represent you in court. If the judgment is in your favor, then you will be rewarded the amount minus any attorney fees.

Is your personal injury claim worth ten million dollars? Well, that depends on what the injury was and how it was caused. In motor vehicle accidents you are unlikely to see that amount but you will see enough to cover the bills and compensate you for your pain and suffering. All those mailers and television ads sometimes do pay off when it comes time to finding a personal injury lawyer.

How Motorcycle Accident Lawyers Protect Your Rights

If you ride a motorcycle in a big city, then I am sure you already know about the day to day hazards you face as you ride on congested streets and highways, and even if you have never had an accident, you must consider the life changing impact of being hit by a motorist while on your bike. First off almost all high speed accidents result in serious injury, and sadly enough there are considerable numbers of bikers who are killed on the freeways, and that is why you need an motorcycle accident lawyer to help protect your rights.

Having an experienced motorcycle accident lawyer to represent you in the event of being hit is the wisest decision you can make in protecting yourself and getting compensation for medical bills, damage to your bike, and in case of serious injury, enough money to cover your future medical bills and needs. There are quite a few views on this subject, and some of them lean towards not trusting lawyers, but if you were in a serious motorcycle accident why wouldn't you want a experienced and aggressive lawyer representing you and protecting your rights?

Some people would have you think that all you need is good motorcycle insurance and you will be protected should you get injured in an accident, and that couldn't the furthest from the truth. Insurance companies are in the business of selling their customers policies for financial coverage in the event that they have an accident, but when they are in the position of being libel for large sums of money if their insurance policy holder is found at fault, and so what if you were hit by an uninsured driver?

In this situation the insurance company takes an aggressive stance to protect their financial holdings so the they can limit any potential negative financial exposure, and that is why you need a qualified, experienced and aggressive motorcycle accident lawyer representing you and your interests. Many times as soon as an insurance company learns that you have retained an experienced motorcycle accident lawyer, they become willing to make a fair settlement right way, because they know a trial will cost them more money!

Every State has different laws that pertain to accidents and insurance and how proceedings are conducted in a courtroom, and by having an experienced motorcycle accident lawyer representing you, your rights will be protected to help you receive the maximum amount of compensation to cover your medical bills, and damage to your motorcycle, as well as pain and suffering.

The Good and the Bad Car Accident Attorney

Not every single car accident attorney out there is a decent one. There are those that know what they are doing, and there are those who are simply after the fees you are obliged to pay them whether you win or lose the case. Knowing the difference can mean a successful legal affair or one that is marked with some seriously expensive fees resulting to nothing. Keep these differences in mind, and you will be able to identify the good car accident attorney from the shams:

The good attorney lets you talk to previous clients. They have nothing to hide, and their clients will be more than happy to recount a successful legal battle in the past.

The bad attorney hides behind legal excuses. Privacy, confidentiality and all that jazz is a setup to get you away from their previous clients. Steer clear of attorneys who dont want you within a mile of their previous clients, especially since they know they seriously botched the case up.

The good attorney looks for facts and solutions. He is dedicated to what a car accident attorney is supposed to do: win your case. The rest are just details.

The bad attorney looks for payment guarantees. He is dedicated to what a typical pathetic excuse for a lawyer wants from you: your money. The rest are just details.

The good attorney is one that you can work with. Warm fuzzy feelings can prove to be useful, especially when a good working relationship helps add motivation to an attorneys pursuit. A friend will be more willing to help you than a nameless face in the crowd.

The bad attorney is one that you dont like. How do you expect this person to defend your case in court if you cant even see eye-to-eye on a personal level? Professionalism can only go so far, especially since arguments and misunderstandings can undermine that professionalism.

The good attorney works quickly and efficiently. Swift proceedings, passing the buck around and getting things done is the mark of a true professional.

The bad attorney likes piling up the bills. The longer you keep such a parasitical car accident attorney along with you, the more chances and opportunities there will be for extra charges.

The good attorney informs you all the time. Youre the one getting in legal trouble here, and your attorney will be more than happy to tell exactly what is going on. This is especially crucial for you, since the ins and outs of such proceedings are beyond the average Joe.

The bad attorney doesnt care about your knowledge. Youre the one getting in legal trouble here, not the car accident attorney. Having to explain every single detail here is just a waste of time, and the attorney sees you as more of a nuisance than someone to help.

Now that you know the good car accident attorney from the leeching schmuck looking to get into your bank account, you can make the right choice and choose someone who will help dig you out of the hole you find yourself in.

After an Accident Or Injury, Do This

If you are hurt in a car accident or a slip and fall or any other type of injury, there are certain things you should do and know - the first of which is to take care of yourself. Seek medical treatment for your pain and injuries immediately. If you felt fine at first but experience pain or discomfort a few days later, get medical treatment. At the end of the day, regardless of who is at fault, your health is the most important thing.

Next, complete an accident form or police report. If you are unable to do so, have an independent, trustworthy party do it. For example, if you slipped and fell in a store, the store is a potential defendant. The store may be reluctant to provide you with an accident report. Get an independent one from the police or demand a signed copy from the store.

Write down what happened. For your doctor's sake, for your lawyer's sake, for the police' sake and for memory's sake, record it in a journal. Memories tend to fade or be skewed over time and you don't want to forget any important (or valuable) details.

But, don't share it with anyone other than the police, your doctor or your lawyer. Tread carefully with potential defendants and their representatives. A potential defendant's insurance company or other representative may try to get you to give a signed statement. Do not do this without a lawyer. You run the risk of having your words twisted and severely hurting any potential case you may have.

In addition to writing down the events as you remember them in your own private journal, take photos and videos of your injuries or other damage. This should also be done immediately and will assist in proving liability. A good Illinois personal injury lawyer will advise you on the importance of such documentation.

Keep accurate records of all medical expenses incurred and lost wages or time away from work. Even if your insurance pays a medical bill, it will still be included in your damages. So, keep track of all of this information.
Be mindful that when neighbors, co-workers, family and friends hear of what happened to you, they will offer unsolicited legal and other advice or share stories of someone in the same situation who recovered a certain amount of money. Do not take any of this to heart. No two cases are exactly the same. There are many differentiating factors, such as degree of injury and other facts.

Instead, do the above and focus on getting well. Until your medical treatment is complete, you cannot settle a case.

Do I Need an Attorney If I've Been Hurt in Motorcycle Accident?

When you are on the road, you are always uncertain whether you can come home safe and sound considering that it is not only you who is on the streets. There are other motorists who are also busy with their own business, some may not be in a hurry to arrive at their destinations, while there are those who are trying so hard to beat the time. When this happens, they may accidentally hit you while you are riding on your motorcycle.

If you have been in a motorcycle accident and somehow you have gotten hurt, it is with a very high probability that you would be consulting your doctor right away. This is a very predictable attitude of men and women who have been in accidents since they would always be concerned about their health. You may be hurt slightly or seriously. You may have been able to make it back home with an injured ankle, or you may also have been brought to the hospital since your condition needs serious medical attention. Whichever the case, seeing a doctor to restore your bodily functions to normalcy is imperative.

However, aside from seeing your doctor, a lawyer must also be sought after. Your doctor can give you the right medication, administer the proper procedures, but they would not be concerned anymore whether you have the money to pay for your medicines, hospital bills, and even their professional fees. Your lawyer on the other hand, understands all these things and would go out of his way to make sure that the person responsible for your injuries can give you the compensation that you need so that you may be able to pay for all the bills that you have incurred pertaining to your injuries right after the accident.

The only way for you to receive the compensation that you deserve is to have your lawyer file the proper lawsuit in court, demanding for damages. You cannot simply walk to the person responsible for your injury and have him pay you thousands of dollars. You need to have the court decide on your case, and this could only happen if you seek out a reputable lawyer who knows the intricacies of the laws pertaining to motorcycle accident injuries.

You would need to inform your lawyer truthfully about the entire accident. You also need to be very cooperative with your lawyers. There are times when the victims and lawyers don't see each other eye to eye, which often leads to the failure of the lawsuit. If you would be asked by your lawyer to appear in court with all the bandages on you, then don't hesitate, this move might actually make it easier for the jury to decide on your favor and award you a compensation which is more than what you asked for.

Motorcycle accidents, especially those in Orange County and Los Angeles County, California, are usually catastrophic. When you or a member of your family are faced with the experience of having any type of accident, it can be very traumatic. This is especially true when an accident you've had involves a motorcycle, and injuries that can result from having a Los Angeles motorcycle accident or Orange County Motorcycle crash for example. There is a wide range of bodily injuries that can be associated with having a motorcycle accident.

Some of the injuries that are involved with having a motorcycle accident can include broken or fractured bones, spinal cord injuries, brain trauma, paraplegia, quadriplegia, loss of a limb, and death. Injuries from motorcycle accidents can last for many months and even last a lifetime; they are sustained from even a slight tap from an auto with little speed. However when there is a high rate of speed like on the open highway or freeway the injuries can be devastating and can end in death for the motorcycle rider.

They will be with you every step of the way, keeping you informed and fighting for your needs.

Getting Proper Motorcycle Accident Compensation

Getting proper motorcycle accident compensation is easy if a few factors are kept in mind during the claiming process. In the event of an accident, a motorcyclist faces a higher risk of injury or fatality. A major percentage of reported cases of motorcycle accidents result in injury or fatality to the rider.

There are several reasons why motorcycle accidents result in more serious injuries to the rider. One of the reasons is that the vehicle itself does not provide any protection to the rider or the pillion rider and so ejection of riders from the motor cycle. Riders are usually thrown off the motorcycle as there are no restraining mechanisms like seatbelts. Motorcycles also lack other safety features like airbags, crumple zones and side impact bars. Therefore, in the event of an accident, a motorcyclist is most likely to be thrown away from his or her vehicle and will forcibly strike obstacles in the path resulting in injury or death of the person.

Due to the above-mentioned reasons, unlike other automobile accident compensation cases, which are often solved and settled fairly quickly, insurance companies are having a tough time making quick settlements on motorcycle accidents. Getting proper motorcycle accident compensation is not so easy and quick to claim and there are many other things involved in it. Therefore it is very important to have a proper damage claim presented to the insurance company in a proper manner in order to expedite the process of getting proper motorcycle accident compensation.

A few things have to be kept in mind immediately after a motorcycle accident. The first and foremost thing to do is to inform the police about the accident and insist on the police taking a report of the accident irrespective of how minor or major the injuries and damages are. There are strict time limits applicable for reporting such accidents and therefore it is advised that such motorcycle accidents are reported to the authorities without undue delay. Photographs of the accident scene are valuable evidence while claiming motorcycle accident compensation. Insurance companies often try to downplay the damage and grant the least possible amount as compensation. Therefore it is essential to convince the insurance companies of the actual value of the motor vehicle after an accident. Filling up the claim forms legibly is also important for quick disbursal of accident compensation. It would be helpful to seek the services of a lawyer specializing in motor accident compensation cases.

The amount awarded as motor vehicle accident claims and compensation depends on the degree of damage to the vehicle as well as the injury to the rider. It also depends on the nature of insurance cover availed. In the UK, accident victims of negligent uninsured drivers are also awarded compensation provided that the identity of the other driver is satisfactorily proved. Victims of unidentified hit and run divers are also considered for the compensation, but the process is a bit tedious compared to cases where the errant uninsured driver has been identified. In such cases, there are very stringent reporting conditions to which all claimants have to adhere to.

To make the process of getting proper motorcycle accident compensation a smooth and easy one, it is essential to consult a motor accident attorney specializing in motorcycle accident compensation. Such lawyers provide advice regarding the exact amount of compensation for which the victim is eligible.

Serious Injury Motorcycle Accident Cases Are Complex Litigation - Part 1

Motorcycle accidents, unfortunately, often result in serious and catastrophic injuries. Some of the reasons are obvious, such as that motorcycles don't have the surrounding metal cage, the safety designed interior padding, seat belts and air bags that protect auto drivers. Some of the reasons are less obvious, such as the "inattentional blindness" that impairs many auto drivers' ability to "see" the oncoming motorcycle often leading auto drivers either to pull out into intersections from side streets or turn left directly into the motorcyclists' path.

Motorcyclists may suffer quadriplegia, paraplegia, other spinal cord injuries, traumatic brain injury, TBI, debilitating internal injuries, catastrophic orthopedic injuries and limb amputations. Our serious injury motorcycle accident lawyers will discuss two of those categories of cases, involving TBI and spinal cord injuries. However, every serious injury motorcycle accident case is "complex litigation," much more complicated than "who ran the red light," and so it is very important that the seriously injured client obtain the representation of qualified lawyers, highly experienced in the preparation and presentation of complex litigation, motorcycle accident attorneys capable of competently presenting to the settlement judge and jury the full measure of the motorcyclist's general and special damages.

We'll contrast the ordinary and serious injury motorcycle accident case without in any way discounting the importance of the ordinary case, because every motorcycle accident case is important for the client and should likewise be important for the attorney. However, it would be inaccurate to say that the preparation or presentation of "general damages," "past and future medical expense" or "past and future loss of earnings" is similar.

For many motorcycle accident lawyers the term "general damages" means "pain a suffering"; but for the true serious injury motorcycle accident attorney, the most persuasive general damage evidence is what we call "loss of enjoyment of life damages." This is commonly the way our seriously injured clients see it. And it can be presented poignantly by juxtaposing the evidence of what the client enjoyed most in his life before the accident, through the testimony of friends, family, home videos and photographs, against a professionally produced "Day in the Life" film, demonstrating the courage of the serious or catastrophically injured client as he confronts and overcomes the challenges of his post accident daily life.

In the ordinary motorcycle accident case the Motorcycle Accident Attorneys might have to present some evidence of past medical expense, but presenting future medical expenses for the seriously injured motorcyclist is hugely more complex. For a more general discussion of motorcycle accident litigation you may consider >"How Motorcycle Accident Lawyers Present Liability Evidence". The presentation of the motorcyclist's future medical expenses commonly requires a number of treating doctors as well as medical experts engaged by the serious injury motorcycle attorneys, and then perhaps most importantly, a life care planner and forensic economist.

In the briefest summary, the life care planner, under the direction of the lawyer will consult with the treating doctors and other medical experts first to derive the client's post accident "life expectancy," and then identify all of the medical expenses, such as additional surgeries, rehabilitation expenses, anticipated convalescent home costs, replacement prostheses, wheel chairs, all the way down to the cost of the medical supplies and sundries that the injured motorcyclist will likely require over the remainder of his anticipated life expectancy.

The serious injury motorcycle accident lawyers will then present the life care planner's report to the forensic economist who will increase the individual medical costs over by the anticipated date they will be required by use of medical cost inflation government statistics, and then with use general inflation statistics to reduce that number to "present value." There is no other proper way to present future medical expense, and if not properly prepared, the Court will likely not permit the evidence to be presented.

Motorcycle Handling Defects

The most crucial aspect to safely riding a motorcycle, of course, is learning how to properly handle one. Once you have the basics down, it is simply a matter of gaining more experience over time and learning how to negotiate more complex traffic scenarios. However, if you don't regularly service your motorcycle, no amount of driving skills or experience may save you from a serious accident. One of the greatest threats to proper handling for even the most experienced of drivers is a steering problem or handling defect. When a rider is not able to steer the bike properly, a severe crash may result.

The Importance of Regular Maintenance

An infrequently or improperly serviced bike is a dangerous bike. In many cases, handling defects develop gradually over time so you may not notice a growing problem until it is too late. To minimize your risk of an accident caused by poor handling, have your bike serviced by an experienced professional trained to look for warning signs of a steering problem. You could also take a maintenance class or learn the details from a friend to service your own bike. Whichever you decide, be sure to check all aspects of your handling each time you perform bike maintenance, including:

Steering alignment
Handlebar position and condition
Steering head condition

Maintaining Your Steering Head Bearings

One of the most important parts of a functional handling system is not visible from the outside of the bike. Motorcycle steering relies on bearings located inside the steering head, which are lubricated to provide for smooth steering. Over time, the grease on the bearings will dry out or be washed out by power washes and rain. When the bearings are not properly greased the handling will become more shaky and unreliable. The bearings can even become damaged, possibly causing the rider to lose control altogether. Because the grease on the bearings wears off slowly over time, you may not realize that your handling is gradually becoming more and more difficult. Keeping your bearings lubricated at all times can help you avoid a potentially severe accident.

If you have properly maintained your bike but still experience handling problems that result in a crash, you may be the victim of a handling defect. Your motorcycle manufacturer may be liable for a defective part, poor design, or improper installation. Likewise, a mechanic may have incorrectly maintained your bike and may be responsible for a handling problem that caused your accident. If you have experienced an accident caused by handling failure, consider contacting a motorcycle accident attorney immediately to investigate the details of your case.

Now You Can Use Your Phone to Make an Accident Claim

A national insurance company has recently launched an application for the iphone which can help drivers to report and collect details for an accident claim if they have been involved in a collision. According to the managing director of the insurance firm, 30% of drivers involved in a road collision do not report the necessary data at the time of the crash and this negatively impacts their ability to make a successful accident claim. With this new application, drivers will be taken through a step by step process, helping them to stay calm.

This is a useful application and does not intend to replace personal safe guards including the police and highway maintenance teams. Neither does it erase the need for a road traffic accident specialist who can help you take your accident claim to court if need be. In fact, lawyers and solicitors have celebrated the application as it helps them if a case comes to court, because they have so much evidence stored digitally.

The features of the application include a health and safety guide. This gives practical instructions of how to stay at the roadside safely as you wait for the emergency services, spotting any danger signs coming from the scene of the crash such as petrol leaks and risk of explosion, and how to avoid disturbing the evidence.

Other areas that the new application can help with are the collecting of third party evidence which can be used by any insurer to assess the accident claim. Studies have shown that the majority of drivers involved in a collision are usually too stressed, confused and traumatised to record vital information. The crash application allows them to record witness details, take photos of the scene and record the exact location of the accident using GPS.

Although this application has been launched by an individual insurer, it can be used in a claim with any insurance company and the driver simply has to input details of their own car insurance company. It is predicted that this will speed up the amount of time it takes for accident claims to be processed as any evidence which is needed can be provided immediately, instead of having to wait for files included in the police report. However, drivers will not be able to manipulate the tool because the insurer and police will not stop communicating with each other over these types of accident.

Some Easy Steps to Avoid Fatal Motorcycle Accidents

Accidents could happen to people who ride motorcycle for a variety of reasons. Fatal motorcycle accidents may possibly happen if bikers do not concern about their safety and break the law they must obey. Motorbike accidents could be avoided if the drivers are able to follow the rules and do the right thing for their own safety. You need to know that your safety means much because you are a worthy person in your family.

The most basic thing people need to do in avoiding fatal motorcycle accidents is by using helmets. The use of helmet is to protect our head as the most important part of our body. By protecting the head, bikers can prevent the horrible thing such as brain damage.

Even if the use of helmet does not have a full guarantee to protect our head but at least it is able to reduce the risk of serious injury or death in the event of an accident. This is why wearing protective gears like riding boots, helmets, and other motorcycle clothing are very important.

Based on most researches, there is a statement that about half of all fatal motorcycle accidents are caused by motorcycle crashes that are ridden by people who consume alcohol. When riding the motorcycles, bikers need to be sure that they do not consume any alcohol in order to keep their selves away from any accidents, which is very predictable to happen if they were in the drunken condition. So, if you are drunk, you need to stop your bike and take a rest!

Being aware is another thing bikers should concern in order to prevent some accidents. People need to pay attention on how to ride the bike considerably skilled and also the necessity to follow the rules and signs that are used for the safety. Other area bikers should observe is the ability in managing the speed because speed takes an important role to stay away from accidents.

Fatal motorcycle accidents are not just bringing on physical injuries but mentally as well. Considering all the cost bikers should carry on his shoulder then it would be an excellent thing to do to have insurance. The motorcycle insurance company will pay for the damages and you can concentrate on your recovery. You can shop for some bike insurance quotes first and compare it before deciding on one. Hopefully you like this simple article and find it useful of course. In the next chance, I will talk about something related to this one, and thanks for visiting.

Making a Successful Motorcycle Accident Claim

It is often the young that have somewhat of a penchant for the motorcycle. Hedonism comes in no purer form than the inherent dangers of this machine. It stands to reason that the combination of speed and diminished protection account for a capacious rate of road traffic accidents pertaining to motorcycles.

It's far from a generalisation, even though it may sound like one, that young people on motorcycles take unnecessary risks. They overtake at inappropriate times, and they ignore traffic light signals. Indeed, the process of litigation, relative to motorcycle claims, presents its own set of rubrics.

It must be considered that the speed and size of motorcycles (think blind spot), often equates to situations whereby blame can be apportioned to another party. Also, the structure of a motorcycle makes it far more susceptible to bad road conditions. A car will simply judder slightly because of a pothole, whereas a motorcycle could flip over, leaving the motorcyclist in considerable difficulty.

The window of undue care and attention, in relation to motorcycles, is far narrower. A motorcycle can evade a person's periphery in a way that the average car simply cannot. This is why so many traffic accident claims, relating to motorcycles, are the result of defendants simply not being aware that the motorcyclist was there.

Police reports, as with any road traffic accident, are of hellacious significance when it comes to making a motorcycle-relative road traffic accident claim. The analysis of a traffic policeman is beyond scrutiny, and any insurance company defence team is going to know, straight away, that they may as well get their cheque book out first as last. Even if an injury is minor, where there is blame there is a claim. Therefore, call the police, and make sure there is a report filed on your behalf.

It almost goes without saying that you'll need a hospital report. If you aren't that badly injured, then an attendant officer cannot force you to go to hospital, and it can be tempting just to get home and get the TCP out. Such action is extremely detrimental when it comes to making a personal injury claim, and so the trip to hospital is prerequisite to being awarded compensation. Your personal injury solicitor will struggle to get you adequate compensation without medical proof of your injury.

How to Find a Big Rig Accident Lawyer

If you have been injured in a truck accident then you need to find a qualified big rig accident lawyer who can handle your case. The most important thing is that you find the right personal injury attorney for the job, and once you do begin to discuss details with your attorney.

1. Locate an attorney that has the proper credentials. It is important when you are filing a personal injury lawsuit that you take the time to hire a good lawyer. Make sure that the attorney that you use is AV rated, is a published author, and also has extensive trial experience.

2. Contact a personal injury attorney who meets these qualifications. It is important that you give your big rig accident lawyer as much information as possible, because that will help him fight your case.

3. Meet with your lawyer in person in order to discuss the details of your case. It is important when meeting a semi truck accident lawyer that you give him or her the full details of the crash, because that is very important. Anything that you leave out will actually hurt you, because your personal injury attorney may be unprepared if the situation comes up in court.

4. Ask your lawyer if he or she will try your case if it does not get settled. This is a huge issue, because many lawyers will leave clients high and dry if a settlement cannot be reached. Make sure that your attorney is there for you even if the case does not settle.

5. Check out the record of your attorney. Many times attorneys will have their best cases featured on a website, and you should check the website out to see what kind of verdicts they have been able to deliver for clients.

Coal Dust Explosions & Black Lung

Mining remains the backbone of many states' economies. However, mining for coal can be a dangerous occupation. Coal is brittle, and the process of mining it can create large amounts of coal dust. Coal dust poses a serious explosion risk, and inhalation of dust can cause black lung disease.

Coal's usefulness as a fuel comes at a cost: because it burns so readily, coal dust suspended in the air can explode if it is ignited. Lumps of coal burn with a steady flame, but breaking coal into smaller and smaller pieces lets it burn more quickly. Since explosions are just fires that happen extremely quickly, pulverizing coal into a dust can turn a column of air into a bomb.

Most of the deadliest mining disasters in history were caused by coal dust explosions, including many mine collapses. Beyond the immediate effects of the blast, explosions can damage supports and safety equipment, making mine collapses much more likely and even limiting mine workers' ability to escape. Explosions can also ignite mine fires that can burn out of control for years.

Even if the dust does not catch fire, it can still cause harm to miners. Inhalation of coal dust can lead to a disease colloquially known as "black lung," which doctors call miners' pneumoconiosis. Microscopic particles of carbon can become permanently stuck if they enter the lungs. Over the years, accumulated dust can limit a worker's ability to breathe and can eventually cause death.

Given the day-to-day risks of coal mining, mining companies have an obligation to ensure that their employees are kept safe. Coal mine explosions and coal pneumoconiosis are preventable if the right safety equipment, proper procedures, and adequate training are provided. Hard-working coal miners should not have to suffer because of their employers' failure to ensure their safety.

Understanding Intentional Torts

Learning that a loved one has died unexpectedly as the direct result of another person or company's negligence is an almost unbearable event. Yet every year countless families must contend with this disturbing news and attempt to pick up the pieces that are left behind in the aftermath of such a tragedy. While it is difficult to be told that your loved one has died as a consequence of an accident facilitated by negligence, this pales in comparison to the abhorrent circumstance of finding that the responsible party acted with either the intent to kill or a complete indifference to your loved one's survival. Such occurrences are deemed "intentional torts" and may be grounds for a wrongful death lawsuit.

Typically, wrongful death lawsuits that are brought in cases of accident where there is no suspected malice involved. Car accidents, pharmaceutical errors, surgical mistakes, and other similar incidences are commonly the cause for such a civil action. These cases are not usually accompanied by a parallel criminal case because the legal system does not hold that incarceration is an appropriate potential punishment for legitimate accidents. This stands in contrast to intentional tort cases where both civil and criminal cases are apt to be levied.

Examples of Intentional Torts

There is no question that the line that divides these two different kind of wrongful death cases can become a bit blurry. Consulting with a skilled and experienced attorney who can advise you about the appropriateness of a civil lawsuit if your loved one has been senselessly killed due to another person's criminal actions is very important. One notable advantage is that you have a greater likelihood of seeing formal justice done because the standard of proof in a civil case is much lower than that in a criminal case. Whereas a criminal conviction requires the demonstration of "guilt beyond a reasonable doubt", a favorable civil verdict only demands a demonstration that "a preponderance of the evidence" suggest that the claims being made are correct.

Examples of crimes that qualify as an intentional tort when they result in the death of the targeted person or another individual are:

Assault
Battery
Extreme indifference to human life
Assisted suicide
Murder
Domestic violence

Motor Vehicle Accidents and Wrongful Death

Every year in America fatalities caused directly by motor vehicle accidents number in the tens of thousands, making car wrecks consistently among the leading sources of accident deaths annually. There are many factors that can play a role in a car crash, but in most instances the negligence of a driver, automobile manufacturer, or other party is the proximate cause. You may be able to pursue a civil lawsuit against the responsible entity that can gain you the financial compensation that you need to address the costs of medical care necessitated and other damages associated with your accident.

An investigation into the causes of a car accident will usually be conducted by the police, highway patrol, or other authorities on the scene and insurance companies may also deploy claims investigators to evaluate the situation. Unfortunately, these investigations do not always attain the level of depth necessary to ensure that all of the appropriate elements have been considered. A skilled and experienced wrongful death attorney, however, can help to give you confidence that all avenues have been exhausted in the effort to secure justice for your loved one who was tragically killed in an accident that could have been prevented had another person or company been suitably cautious.

Fatality Factors

Despite the substantial advances that have been made in automotive safety over recent decades, the physical realities of highway collisions and even surface street accidents at lower speeds are such that the drivers and passengers who are involved face a significant risk of serious injury or death. At speeds of 20 miles per hour or greater, the body is not naturally equipped to handle the force of impact. Moreover, the weight of the vehicles and the conversion of parts and windows into projectiles or sharp edges turn the vehicles themselves into hazards.

Though the variety of things that could conceivably be involved in a fatal car accident seems essentially limitless, there are a number of factors that appear most often. These include:

Highway defects
Automobile defects and malfunctions
Air bag failures
Brake malfunctions
Distracted driving
Driving while intoxicated
Excessive speed
Reckless driving
Driver error

Knowing Your Rights

As you attempt to put the pieces together after the sudden and unexpected loss of your loved one, it is important that you know your legal rights.

Motorcycle Accidents Usually Mean More Severe Injuries

Motorcycle-riding is never for the faint of heart. Every day, there are hundreds of accidents happening in and out of the city because of motorcycles. Regardless of whether you have your own motorcycle or not, accidents caused by these vehicles may sooner or later happen to you. In fact, many of the accidents involving this vehicle happening usually involve more people that are merely pedestrians or bystanders. If you're one who has just recently figured in a motorcycle accident, then you might want to consult an accident lawyers for legal advice.

Of course, the first thing that you should do after being injured in an accident involving a motorcycle is to seek medical assistance. Regardless how minor the injury could be, this could still affect your total wellness. It is then a must that you take care of your health by making sure that all the wounds and scrapes you got from any motorcycle mishap are properly treated.

After the medical check-up comes the consultation with an accident attorney. An accident lawyer can easily assist you in claiming for a just settlement out of the vehicular accident that you figured into. With his aid, your chances of winning that accident litigation are very high. This is in comparison with a person who got involved to a motorcycle accident but chose to carry on the settlement battle on his own without any legal assistance.

More often than not, being involved in a motorcycle accident usually ends up having to deal with more severe injuries. This is why you need to tell your motorcycle accident lawyer everything that happened during the accident, including the minutest details. All the things that you will tell him will immensely help in pinning the appropriate evidence necessary for your case. In a number of cities, for instance, people who have been victims of motorcycle accidents are advised to consult a motorcycle accident lawyer with substantial litigation experience because he generally has a fair idea of how much your settlement is really worth. He or she would also be able to help you prepare the needed documents in order to file an effective claim.

By the time your attorney has successfully claimed a settlement in your behalf, the money will eventually start to come pouring in. There are times, however, that the settlement will take a long time to be compensated due to the long, tedious legalities involved. This should not, however, cause you to lose hope in getting your just compensation.

Types and Causes of Wrongful Death Cases

The causes for a case resulting in a death claim are potentially unlimited, but there are four major categories which have the highest probabilities.

Motor Vehicle Accidents

In 2007, 41,059 people died in motor vehicle accidents in the United States. While there are no statistics available as to how many of these were due to the negligence of a third party, the likelihood of wrongful death is highest in this category given the sheer number of fatalities.

Common causes of fatalities in motor vehicle accidents that result in lawsuits include speeding, reckless driving, driving while under the influence, vehicle equipment malfunction and driver inexperience.

Medical Malpractice

Medical malpractice occurs when a physician does not provide medical care to an expected standard of competence or dispenses medical treatment that a competent doctor would not have given. This may also be applicable to health care providers, such as nurses.

Preventable medical errors take the lives of approximately 98,000 Americans per year. That equates to 285 deaths every day.

Medical malpractice runs the gauntlet from prescription mistakes to failure to diagnose or misdiagnosis to negligent maternity care, with an alarming number of causes in between.

Workplace Accidents

In 2007, a total of 5,888 people died as a result of accidents in the workplace.

The number one cause of these types of cases was motor vehicle accidents and represents approximately one-quarter of the workplace fatalities.

In 2007, 835 workers died in falls, whether from non-moving vehicles, on the same level, into holes or from roofs, to place this form of workplace accident in second position.

Other workplace accidents noted in the Department of Labor's statistics were caused by: falling objects; electrocution; homicides; railway incidents; aircraft incidents; struck by mobile equipment; fires and explosions.

Ninety percent of workplace fatalities occur in the private sector, primarily in the service providing and goods producing industries.

Product Liability

One out of every 125 men who dies over 50 years old is a victim of asbestos-caused diseases. It can take from 10 to 40 years for diseases caused by asbestos to develop.

Ten thousand deaths per year are attributable to asbestos, just under 3 per day.

Approximately 9,000 people die each year from food poisoning. Deliberate product tampering or unsafe manufacturing practices which cause accidental contamination may be at fault.

Product cases can also stem from pharmaceuticals, unsafe packaging, failure to place warnings regarding the product on packaging, mechanical failures, improper or unsafe building construction and unsafe vehicle design.

The above information is not meant to be comprehensive but, rather, a general overview of common causes of wrongful death.

To receive specific legal advice pertinent to your circumstances, an experienced personal injury attorney should be consulted.

Attorney Richard Hastings, for the past two and one half decades, has been helping injured clients and families collect millions of dollars in losses ranging from motor vehicle accidents to wrongful death, to medical malpractice. He is the founder of Selectcounsel, LLC, a free service that helps you find one of the best lawyers in your area and is the author of the books "How To Find A Great Lawyer" and "Understanding And Improving The Value Of Your Personal Injury Case."

Motorcycle Accidents & Lawsuit Pre Settlement Loans

When it comes to motorcycle accidents you're talking about one of the most serious types of accidents that can occur related to moving vehicles. Motorcycle accidents usually result in very serious injuries if not fatalities. According to the National Center for Statistics & Analysis in 2005 4,553 motorcyclists were killed with an additional 87,000 injured in the United States; these means 5% of all motorcycle accidents result in death. Unlike common belief, less than one forth of all motorcycle accidents aren't due to negligence of the motorcyclist. Majority of the people involved in motorcycle accidents receive serious injuries and the lawsuits related to motorcycle accidents can take years to reach a verdict.

How does someone injured severely in a motorcycle accident financially support themselves during the long process of their lawsuit? One answer is a lawsuit settlement loan. Lawsuit settlement loan providers understand that a motorcycle accident can leave the motorcyclist severely injured and unable to work; in this same process since they are injured and cannot work it's impossible for them to keep up with bills; including medical bills, mortgages, car payments, etc. Due to that specific reason many plaintiffs in motorcycle accident lawsuits seek settlement loans to get cash to financial survive during their pending lawsuit.

Your probably wonder, "What is a lawsuit settlement loan?" It's really a simple concept; it's when a settlement loan provider gives you a monetary loan based on your motorcycle accident lawsuit. They review the case and speak with your attorney to see how sound the pending lawsuit is against the defendant and then determine how much money the plaintiff can be loaned. You can specifically ask for a certain amount in a settlement loan, or ask how much money you could be loaned if a lawsuit loan is required. This is a great option for a plaintiff who was seriously injured in a motorcycle accident due to the negligence of another driver.

The absolute best part of a lawsuit settlement loan is the fact it is not really a loan. It is actually a non-recourse debt; this is due to the fact that if you lose your pending lawsuit you are not required to pay back the settlement loan. That's right, you "ARE NOT" liable to pay back the money they provided you unless you "WIN" your lawsuit. Another interesting fact is your credit history, employment history and income do not play any role in the approve process of a settlement loan. So, if you're in the middle of a motorcycle accident and need access to cash why not consider a lawsuit settlement loan. You can learn more about lawsuit loans for motorcycle lawsuit cases below.

How to Choose an Experienced Motorcycle Accident Attorney

Motorcycles were practically made for a place like Arizona, as the climate is completely conducive to riding on the open road without any worry of cold or ice.  Additionally, motorcycle riding is a quasi subculture in the United States, and riders tend to recognize other riders and travel in packs to maximize their enjoyment.

However, driving a motorcycle is also inherently dangerous, as drivers and passengers are completely exposed and vulnerable when facing a collision with any other type of vehicle, as they are much larger and built to withstand collisions, unlike motorcycles.  Even when wearing a helmet, a high-speed crash can leave devastating results in its wake.

Statistics tend to bear that out.  In 2007 in Arizona, the following facts were reported by the Arizona Department of Transportation:

Number of motorcycle accidents - 3,565
Number of fatal crashes - 144
Number of people injured in motorcycle crashes - 2,929

While these numbers may seem small compared to the 141,000 motorcycles registered in Arizona, the fact remains that motorcycle crashes lead to injuries and fatalities, and if you've been involved in one, you need to choose the proper motorcycle accident lawyer

How to Choose Proper Representation

When you decide to contact a motorcycle accident lawyer in Arizona, you need to make sure that you're diligent in your evaluation process.  Below are a few items to consider and questions to ask when you do meet with an attorney.

Pay attention to how long it takes for a firm to get back to you, as it speaks to their level of service.
Be mindful of how quickly the firm is able to get you in for an initial consultation.
When you meet with an attorney, make sure to ask the following questions:

How long have you been practicing?
How many motorcycle accident cases have you handled?
How many of those cases settled?
How many went to trial?
What were the general results of these cases?
What is your fee arrangement?

Trust your instincts. If you pursue a claim, you will be working closely with your motorcycle accident attorney, and you'll need to be comfortable with how he or she approaches the case at hand and the dynamic between the two of you.

What to Do After a Motorcycle Crash

A motorcycle crash can be a shocking, terrifying, and life-threatening experience. Crashes can happen before either party has time to react, causing severe injury and damage to everyone and everything involved. The events immediately following an accident can be chaotic and emotions are often running high. If you are in a serious accident, it can be difficult to stay focused on the important things and set aside your anger, frustration, and panic. Knowing how to respond after a crash can help you ensure that you get the necessary assistance and information that you need.

After the Impact

The force of a collision is incredibly jarring and will likely leave you shaken up both physically and emotionally. Before getting out of the car or even calling 911, check yourself and any passengers over for injuries. You may not immediately feel any injuries because of the shock of the crash, but it is important to determine if you have any major injuries before trying to move. If you are capable, move yourself and your vehicle to the side of the road, a nearby parking lot, or a cross street to get out of the way of traffic. Turn on your flashers to make the crash scene more visible to oncoming drivers.

Calling for Assistance

Once you are safely out of the road, call 911 immediately for assistance. Even if you do not think that you are seriously injured, it is best to be checked over by an emergency medical technician to be sure. If you are seriously injured and cannot clear the road, let the 911 dispatcher know so that s/he can send the appropriate assistance to protect you from traffic. Once the police and ambulance have arrived and you have been checked for injuries, be sure to exchange personal and insurance information with the other driver(s) involved. If you cannot physically exchange the information yourself, ask a police officer to do it for you.

Important Tips

After an accident, the most important thing to address is your personal safety and the safety of others involved. The second most important aspect is to gather any and all information regarding the accident. Be sure to do the following after any accident:

Stay calm. Yelling at or accusing other drivers is counterproductive and will not help the situation.

Write down information. Get all necessary information from the other driver and write down details of the accident, including accident time, location, and parties involved.

Take photos of the accident. Documenting the scene of the accident and the extent of the damage on the scene can help with your insurance claim.

Do not discuss fault. Police officers are not authorized to give legal advice and cannot discuss fault with you. It is up to the investigators and insurance companies to determine fault.

Call your insurance company. Report the accident as soon as possible to your insurance agent. The sooner you report the collision, the faster your claim will be underway.
Once you have been treated for injuries and completed the above steps, consider contacting a motorcycle accident lawyer. Accidents can be costly to your health and your wallet, and a motorcycle lawyer can work with you to determine if you have grounds to recover compensation from another party. Someone may be liable for your accident and may be obligated to compensate you for your medical bills, rehabilitation, lost wages from time off of work, vehicle damage, and pain and suffering.

Protective Motorcycle Gear

If you drive a motorcycle, you know how dangerous the speed can be. Protective gear is a must. In Europe, motorcycle clothing undergoes a series of tests such as abrasion tearing and impact tests to ensure the utmost safety. If you live in the US, you may want to keep the following points in mind because there are no such tests for our gear. When it comes to motorcycle parts, a rider's protective gear is one of the most important elements.

1. The pants you wear should be reinforced at the knee and the hip to provide quality protection. You should also wear some sturdy, high topped boots made of thick leathers that has a flexible sole.
2. Other than leather, a thick nylon or other synthetic materials are great for your motorcycle gear as well. If you wear jeans, invest in the Kevlar brand, they are most resistant to abrasion. If you wear a leather jacket get one with reinforced elbows and shoulders. The leather should be thick and durable, and some sort of impact protection would be ideal.
3. Always wear a quality pair of gloves with reinforced palm patches. Knitted Kevlar gloves are a great choice and reinforced leather is a plus.
4. Enable a certain degree of protection by wearing impact gear. Sold separately, you can get clothing that has impact protection built in to provide you with the safety you need.

Wrongful Death Lawsuits in Car Accidents

Car accidents are common occurrences in the world. You can be a witness to it or be a victim yourself. With the increasing number of vehicles that are on the road everyday, the number of vehicular accidents also continues to increase, making it hard for ordinary people to feel safe whenever they are walking or jogging on the street. In some accidents, physical injuries may result, but in more severe cases, death follows the accident.

When death becomes the result of a vehicular accident, one can only surmise the ramifications. You can immediately think of the family of the person who just got hit by a negligent or drunk driver. It is not only about the extreme pain and sadness felt by family members that should be the utmost concern; it also has something to with the notion that the head of the family is gone for good. If the one who died was a child, knowing that his smile would no longer grace the table in the morning and evening will be unbearable.

Aside from the emotional pain, financial distress becomes a heavy toll on the shoulders of family members. Everything nowadays is really expensive and even burial puts a heavy burden on the shoulders. After the burial, there are still so many things that the victim's family needs to take care of. And the worse is that several weeks after, bills and other household expenses would pile up. All these distressful events would be experienced by the family of the victim, and without the right compensation, they would surely be in dire strains.

When death of a family member results from an accident, the best thing to do is to consult the right lawyer immediately. Members of the family must always bear in mind not to entertain insurance company agents considering that they would always try to convince you to accept a settlement for a particular amount that would be enough to cover your expenses. However, in the settlement that these agents offer, it would not include future stress, and other burdens that are most likely to arrive which are related to the death of the family member who was killed in a traffic accident.

Lawyers can be relied on to acquire the right kind of compensation for the whole family. They understand the financial hardships brought about by the death of the head of the family. They can do the proper bargaining with regards to the amount of settlement, and not only make the insurance company pay the amount you deserve, but also have them to pay more.

Work Accident Claims - Knowing Your Rights

Last year there were 1.2 million working people who were suffering with an injury or illness which they believed was caused, or made worse, by their work. In total, nearly 30 million days were lost during last year alone because of work related illness or injury.

Though these numbers may seem very high, they are actually very small when looked at in percentage terms. These figures equate to just 870 reportable injuries per 100,000 workers. The organisation responsible for managing health and safety in the workplace are the HSE (Health and Safety Executive). The HSE supply employers with the guidelines and regulations they are required to follow in order to keep their employees safe.

In the last 30 years the HSE have made the workplace significantly safer. In the period between 1974 and 2009 the rate of fatal injuries in the workplace per 100,000 people fell by 84%. Though a large part of this reduction is due to a shift from heavy manual work to lighter services it is also largely down to risks in the workplace being managed better.

The work that the HSE do means that employers have no excuse for not ensuring your health and safety at work. If you have suffered an accident at work or a work related illness due to circumstances which, you believe, should have been managed better by your employer, then it is likely that you have grounds for a compensation claim. If your injury or illness is caused by your work then it should not be you that has to meet the financial cost of it. Work accident claims procedures are designed to award the employee with enough monetary compensation to cover the full cost of the injury. This may include ongoing treatment, operations, or counselling.

If you have suffered an injury or illness because of work then you should not feel bad about pursuing a work accident claim. You may be legally entitled to compensation, but it is up to you to make the first step by making a claim. Employers have insurance that covers the costs of work accident claims. It is also illegal for an employer to sack an employee due to work accident claims.

The work accident claims procedure is designed to ensure that those with a genuine claim can be adequately compensated. However, it is important to remember that work accident claims must be made no more than 3 years following the incident. This means that if you have suffered an accident and it was genuinely not your fault then you should seek legal advice as soon as possible.

Hiring an Accident Claim Lawyer

When you are involved in an accident, it is likely that you will want to get justice for any injuries or expenses that you have suffered. This is especially true if the actions of another person or organisation caused the accident. If you decide to take action to reclaim compensation for yourself, it is likely that you will want to hire an accident claims specialist or compensation lawyer. This article will run through some of the points you should consider when looking to hire a solicitor.

Location
You should hire a solicitor who is based close to your residential location. This will make it easier to set up meetings and talk through your case with them. However, if you find a solicitor who you want to work with that is further away, they should make the effort to come out and visit you.

Firm Or Solo
Even though solicitors represent on an individual basis, they will talk with their fellow legal minds about cases and ask them for their help when needed. With this in mind, you need to decide whether you want to hire an accident claim specialist who works alone, or one that is part of a firm. I have always thought that firm-based lawyers are better equipped to deal with personal accident claims.

Previous Cases
You can do some research on the internet into your prospective lawyer because some cases will be reported in local news papers or local websites. You can also ask them to present some case studies of their wins and losses to you so that you are better able to decide if they are the right lawyer for you.

Expertise
Solicitors will tend to specialise on one area of the law as this means that they can dedicate more of their time and become a true expert. In turn, this should win them more clients and they should win more cases. You should try to pick a lawyer who specialises in personal injury, accident claims and compensation as they will have more knowledge of previous cases and results than a lawyer who deals with family law for example.

These are just some tips to help you choose a lawyer. Raleys solicitors and other local law firms will be able to help you make your decision.

Criminal Defense Or Personal Injury Attorney - When is it Time to Call One?

There are times when accidents happen through a series of events that are no one's fault. Acts of God, inclement weather or your own mishap of coordination can sometimes result in some injuries. Other times, someone else's negligence or aggression are the cause of pain and personal suffering that is just plain unfair. A personal injury attorney can balance the scales and allow compensation for the victim.

Personal injuries can occur in accidents involving automobiles, a commercial establishment, and a home, at work, on a farm or during a recreational outing.

In the cases involving cars or other modes of transportation, an accident that has resulted in injury due to negligence on the part of another driver are examples of unfair injuries.

A commercial facility such as a restaurant, day care center or a retail shop has a responsibility to the public that it serves to oversee the safety in their establishment. Food should be safe to eat, walkways should be free of slippery spills and hazards, and the employees should be trustworthy. Play structures at a day care facility should be safe for young children as well as properly monitored.

An injury may occur in someone's home due to negligence, faulty construction or even an act of aggression on the part of the homeowner. A repair person or contractor may become injured in the home of one of their customers as well.

Workplaces may not be adhering to proper safety regulations and procedures. Their laxity can result in unfair injuries.

Farms have multitudes of machinery that can be dangerous, in terms of broken bones and loss of limbs or fingers, if not properly utilized and maintained. Amusement parks and sporting events provide entertainment and recreation but they are also the settings for hazard and need to be maintained and monitored by those who are in charge. All equipment should be kept up to the highest degree of safety codes possible.

If you've been unfairly injured, there are time constraints pertaining to each case. It would be wise to contact a reputable personal injury attorney as soon as possible in order for proper documentation to take place. Time constraints will vary depending on the circumstances, and your attorney will know what to do and when to act in order to meet these deadlines.

In some cases, insurance companies pay benefits to accident victims. Your attorney will be able to guide you and represent you against insurance companies, who are notorious for paying out as little as possible in claims.

If you think it may be time to call a personal injury attorney to address an unfair dose of pain and suffering that has been inflicted on you, it's best to act rapidly. Call today to make an appointment for a consultation to discuss your rights.

Ezip 900 Electric Scooter - A Fun Look at the Ezip 900

We bought our 14 year old son an Ezip 900 electric scooter, as a last ditch effort to get him out of the house! He had admired one that his best friend had, so we surprised him with it on Christmas morning. He seemed real excited about it, and now that he has ridden it for a couple of months, we have had a chance to evaluate it's many features and qualities.

First of all, I must admit that I caught the "bug", and now I ride the Ezip 900 myself! It handles my weight easily, as it has a weight capacity of 240 lbs. The relatively high weight capacity explains it's popularity with older kids and adults.

When I first heard that it has a top speed of 15 mph, it didn't sound particularly fast to me. However, now that I have ridden it, 15 mph is PLENTY fast. It does a good job of pulling me up hills, too.

We have several parks and stores near our home, not to mention several of my son' friends. The scooter is perfect for reaching those destinations, so we don't have to drive the car.

It actually has a range of up to 12 miles on a charge, and can run continuously for up to 40 minutes. I find that I can ride it for most of the afternoon, if I stop fairly often.

The battery pack has 24 volts, and takes about 6 hours to re-charge. I generally re-charge it overnight. The Ezip 900 electric scooter has a smooth ride thanks to it's twin suspension fork, and 12 inch, street slick tires.

The front disc brakes provide sure, crisp braking, regardless of the terrain. This model looks sharp, too, with polished 5 spoke mag wheels. The deck consists of wide, 9-inch, extra thick ABS material which resists cracking.

I must say, though, that I feel a touch guilty about riding my son's Ezip 900 so much. I guess I'll just have to "break down" and get one for myself

Motorcycle Accidents and Disability

Automobile accidents claim more lives than any other type of accidental death and are responsible for innumerable injuries. However great the risks are for the average driver, the consequences of an accident are much more serious for a motorcyclist-often leading to long-term disability. If you apply for disability aid after a motorcycle accident, it may be difficult to prove to the court that the accident was not your fault. But an Indiana disability lawyer can help you get the money you need to recover.

For many people, motorcycles have numerous advantages over cars. They are extremely maneuverable and far more efficient than other gas-powered vehicles. Unlike bicycles, they can be taken onto highways and ridden over long distances. Many motorcycle owners also enjoy the sense of independence and freedom a motorcycle can bring. Despite the many benefits of motorcycle ownership, there are downsides.

Unfortunately, however, many of these benefits come with a reduction in safety. Since motorcycles are capable of accelerating very quickly, they can be dangerous for less-cautious riders. They also offer almost no protection in the event of an accident. For that reason, after a motorcyclist is injured, disability authorities are sometimes reluctant to believe that the accident was beyond the rider's control. Without rock-solid proof, you might not receive the help you need.

If you have been seriously injured in a motorcycle accident that wasn't your fault, leaving you unable to work, you are entitled to disability help from the Social Security Administration. A compassionate Indiana social security lawyer can help you find the financial stability you need after an accident.
